1. Information We Collect

We may collect and retain confidential or proprietary information shared by clients, including but not limited to:

- Business plans, pricing, customer and vendor lists

- Technical data, strategies, processes, and know-how

- Financial records and marketing plans

- Personal information required to fulfill contractual services

All information is considered confidential unless otherwise agreed upon in writing.

2. Use of Information

We use the information provided solely for the purpose of delivering the services agreed upon in our signed agreements. EFOGI does not sell or rent your data. Any use of your information will be directly tied to:

- Service delivery

- Internal analysis or planning

- Legal or compliance requirements

- Communication necessary to maintain the engagement

3. Confidentiality and Security

EFOGI abides by the terms outlined in our Mutual NDA and LOU, which include:

- Limiting disclosure of Confidential Information to employees, contractors, and affiliates on a need-to-know basis who are under binding confidentiality obligations.

- Prohibiting use of Confidential Information for purposes outside of the agreement.

- Implementing reasonable administrative, technical, and physical safeguards to protect your data.

4. Disclosure of Information

We may only disclose confidential information:

- With the express written consent of the disclosing party

- To professional representatives (legal, financial, or advisory) under similar confidentiality obligations

- As required by law, subpoena, or governmental request, with advance notice where legally permissible

5. Ownership of Information

All intellectual property or proprietary information developed or shared under an EFOGI agreement remains the property of the Client unless otherwise outlined in writing. EFOGI will not use or reproduce any such materials without consent.

6. Data Retention

Client information will be retained only for as long as necessary to fulfill the terms of service, comply with legal obligations, or resolve disputes. Inactive accounts beyond 12 months may be closed, and data securely destroyed unless otherwise agreed upon.

7. Rights and Remedies

In case of breach or unauthorized disclosure, the harmed party may seek injunctive relief or damages, as outlined in our NDA. EFOGI recognizes that financial compensation may be inadequate and will cooperate fully in remedying such events.

8. Governing Law

This policy and all agreements governing client data are governed by the laws of the State of Michigan, without regard to conflict of law rules.

9. Modifications

This Privacy Policy may be updated from time to time. Any changes will be shared with Clients through official communication channels, and continued use of services constitutes acceptance. Questions or Concerns?
